Today's Your Last Chance to Legally Endanger Your Child's Life on a Motorcycle

Take the little Hell's Angel on the road for one last ride.

Sorry to break it to you, but today, May 18, is the last day you can legally endanger your small offspring’s safety when taking them on a spin on your motorcycle.

According to Republic Act No. 10666, effective May 19 “[i]t shall be unlawful for any person to drive a two (2)-wheeled motorcycle with a child on board on public roads where there is heavy volume of vehicles, there is a high density of fast moving vehicles or where a speed limit of more than 60/kph is imposed…”

All three instances appear to be no brainers, but are they?

Roads with a “heavy volume of vehicles” these days of course means every single road in Metro Manila, and pretty much every major road anywhere in the Philippines, so that seems reasonably comprehensive.

However, we’d like to know where this theoretical “high density of fast moving vehicles” they speak of can be found in our country. Really, we need to know.


Finally, there’s a new 60 KPH speed limit, which still seems fairly high for a joyride with the little person that’s supposed to carry on your life’s legacy. However, the 60 KPH limit appears arbitrary as the current speed limit “on through streets or boulevards, clear of traffic” is 40 KPH, while a 30 KPH applies “on city and municipal streets, with light traffic, when not designated through streets.” Only “on open country roads with no blind corners,” where you can currently go 80 KPH, will you have to rein in your Easy Rider tendencies.

Of course, you may continue doing your thing if your junior Bandido fulfills the following criteria:


(a) The child passenger can comfortably reach his/her feet on the standard foot peg of the motorcycle;

(b) The child’s arms can reach around and grasp the waist of the motorcycle rider; and


(c) The child is wearing a standard protective helmet referred to under Republic Act No. 10054, otherwise known the “Motorcycle Helmet Act of 2009.”

So, if you plan to legally take your little Hell’s Angel with you on bike rides, do make sure she’s just about tall enough to hold on for dear life and wears a brain bucket.
